ЄВРОПЕЙСЬКІ СТАНДАРТИ СТІЙКОСТІ ПІДПРИЄМСТВ КРИТИЧНОЇ ІНФРАСТРУКТУРИ (CER) ЯК НОВИЙ ЧИННИК ПРАВ ЛЮДИНИ Й ЕКОНОМІЧНОЇ БЕЗПЕКИ ДЕРЖАВИ
Стаття присвячена обґрунтуванню управлінської ролі європейського стандарту стійкості суб’єктів критичної інфраструктури (Critical Entities Resilience, CER) як спільного чинника, що одночасно забезпечує права людини й економічну безпеку держави. Показано, що Директива (ЄС) 2022/2557, ухвалена 14 грудня 2022 року й застосовна від 18 жовтня 2024 року, змістила управлінський фокус із фізичного захисту об’єктів на безперервність надання життєво важливих послуг, через що стійкість підприємства перетворюється з технічного завдання на інструмент реалізації соціально-економічних прав громадян. Метою роботи є розроблення аналітичної моделі, яка пов’язує управлінські інструменти CER із гарантіями прав людини та функціями економічної безпеки держави в умовах війни та європейської інтеграції. Методологічну основу становлять порівняльно-правовий аналіз, системно-структурний підхід і теорія організаційної стійкості; емпіричним тлом обрано підприємства енерго-, водопостачання й водовідведення у Харківській, Сумській і Чернігівській областях. Результатом дослідження є трирівнева матриця відповідності «інструмент CER — гарантія права людини — функція економічної безпеки», що дає змогу обґрунтувати рекласифікацію стійкості підприємств критичної інфраструктури як вимірюваного об’єкта державного управління, а не допоміжної технічної функції. Установлено розрив між активо-орієнтованою логікою Закону України «Про критичну інфраструктуру» та сервіс-орієнтованою логікою CER і запропоновано напрями його усунення в умовах адаптації до acquis ЄС. Наукова новизна полягає у виявленні подвійного — правозахисного й економіко-безпекового — ефекту управлінських інструментів CER та в обґрунтуванні стійкості як самостійного об’єкта державного управління, що відрізняє запропонований підхід від технічного трактування стійкості. Як емпіричне тло обрано підприємства енерго-, водопостачання й водовідведення у прифронтових Харківській, Сумській і Чернігівській областях, де безперервність послуг безпосередньо визначає реалізацію прав громадян. Практичне значення результатів полягає в придатності матриці для розроблення галузевих планів стійкості, програм відновлення та критеріїв оцінювання державних і комунальних підприємств життєзабезпечення. Під час підготовки статті інструменти штучного інтелекту використано допоміжно — для редагування мовностилістичного оформлення та впорядкування бібліографічних описів; формулювання наукових результатів, аналіз джерел і висновки належать авторам, що відповідає принципам академічної доброчесності та політиці видання щодо використання штучного інтелекту.

Subject and purpose. The study addresses the managerial role of the European critical entities resilience standard (CER) as a shared factor that simultaneously secures human rights and the economic security of the state. The purpose is to develop an analytical model linking CER management instruments with human-rights guarantees and economic-security functions of the state under war and European integration.
Methodology. The research relies on comparative legal analysis, a system-structural approach, and the theory of organizational resilience. The empirical background covers energy, water-supply, and wastewater enterprises in the front-line Kharkiv, Sumy, and Chernihiv regions; official RDNA5 and RDNA4 assessments, EU and Ukrainian legal acts, and international human-rights instruments serve as the evidence base.
Results. A three-level correspondence matrix “CER instrument — human-rights guarantee — economic-security function of the state” is proposed. It substantiates reclassifying the resilience of critical-infrastructure enterprises as a measurable object of public administration rather than an auxiliary technical function, and reveals the gap between the asset-oriented logic of Ukrainian law and the service-oriented logic of CER. The matrix confirms the hypothesis that CER instruments produce a dual effect, reinforcing both citizens’ socio-economic rights and the state’s economic security. The novelty lies in describing the managerial mechanism that connects, at the level of a single enterprise, the previously separated human-rights and economic-security dimensions of resilience.
Practical implications. The matrix is applicable to designing sectoral resilience plans, recovery programmes, and assessment criteria for state-owned and municipal life-support enterprises, aligning Ukraine’s critical-infrastructure governance with the EU acquis. AI tools were used in an auxiliary capacity only, for language editing and bibliographic formatting, in line with academic integrity principles and the journal’s AI policy; all findings and sources are the authors’ own.
