МОДЕРНІЗАЦІЯ СИСТЕМИ ДЕРЖАВНОГО ЗЕМЕЛЬНОГО КАДАСТРУ

 

Описано сутність понять «земля», «земельні ресурси» як об’єкта життєдіяльності людини, їхнє підтвердження у нормативно-правових актах України. Адже ці терміни базові для важливих законів України: «Про державний земельний кадастр», «Про державний контроль за використанням та охороною земель», Земельного кодексу України.

Виокремлено основні функції земельних ресурсів, тобто дії, що впливають на об’єкти, забезпечуючи соціальний, екологічний або економічний результат.

Розроблено структурно-логічну модель державного регулювання у сфері земельних відносин, яка дає ефективний результат для збалансованого задоволення потреб держави і населення. Представлено структурно-логічну схему земельних ресурсів, яка забезпечить успішну реалізацію поставлених перед державою завдань щодо управління земельними ресурсами.

Виокремлено компетентні органи влади у сфері адміністрування земельних ресурсів, що забезпечують регулювання та контроль за їхнім використанням. Показано систему державного контролю за використанням земель в Україні, її мету, завдання, суб’єкти та принципи. Проаналізовано світовий досвід моніторингу у сфері Державного земельного кадастру (ДЗК), що дає Україні успішно адаптуватися в умовах сьогодення. Подано перелік, зміст та основні принципи нормативно-правового забезпечення системи ДЗК. Описано етапи оцінювання її ефективності.

Викладено основні етапи розробки стратегії державного регулювання в системі ДЗК, що дасть змогу ефективно використовувати земельні ресурси.

Запропоновано модель цифровізації процесів у системі ДЗК, що дозволить суттєво контролювати раціональне використання земельних ресурсів регіону. Показано результати функціонування цифрової системи земельних ресурсів на прикладі Львівської області. Відображено систему обміну даних земельними ресурсами у єдиній цифровій екосистемі, яка базується на здатності різних систем взаємодіяти між собою.

This paper discusses the concepts of "land" and "land resources" as essential objects in human life, along with their recognition in the regulatory and legal documents of Ukraine. These terms are fundamental to key Ukrainian legislation, including the "On the State Land Cadastre", "On State Control over Land Use and Protection", and the Land Code of Ukraine.

The primary functions of land resources are highlighted, focusing on actions that influence these resources and lead to social, environmental, or economic outcomes.

A structural-logical model of state regulation concerning land relations has been developed to ensure a balanced satisfaction of the needs of both the state and its citizens. Additionally, a structural-logical scheme of land resources is presented, which aims to facilitate the successful implementation of state objectives in land resource management.

The paper identifies the competent authorities responsible for land resource administration, outlining their role in regulating and controlling land use. The system of state control over land use in Ukraine is described, including its purpose, objectives, subjects, and guiding principles. Furthermore, the study analyzes best global practices in the field of State Land Cadastre (SLC) monitoring, which can help Ukraine adapt to contemporary challenges. It provides an overview of the regulatory and legal framework of the SLC system, detailing its components and fundamental principles. The stages involved in evaluating the system's effectiveness are also described.

The main steps of developing a strategy for state regulation in the land management system are outlined, which will enable the effective use of land resources.

A model for digitizing processes within the land cadastre system is proposed, enabling enhanced oversight of rational land resource usage in the region. The results of this digital land resource management system are illustrated through a case study of Lviv region. The framework for land resource data exchange is represented within a unified digital ecosystem, demonstrating how various systems can effectively interact with each other.
