ДОСВІД УКРАЇНИ У РОЗВ’ЯЗАННІ МІЖНАРОДНИХ

ТОРОВЕЛЬНО-ЕКОНОМІЧНИХ СУПЕРЕЧОК В РАМКАХ СОТ

 

Теоретично досліджено процедуру вирішення спорів в рамках Світової організації торгівлі. Проаналізовано досвід України у веденні торговельно-економічних суперечок в рамках СОТ, зокрема визначено їх суб’єктно - об’єктну характеристику, систематизовано порушені статті та їх наслідки. Зроблено висновки про необхідність покращувати дипломатичні торговельно - економічні відносини з країнами; підвищувати рівень професійних знань та компетенцій представників національних зовнішньо - економічних органів з метою захисту та поліпшення національних торговельних інтересів.

Яценко О.Н., Ускова Д.С. Опыт Украины в решении международных торгово-экономических споров в рамках ВТО. Теоретически исследовано процедуру решения споров в рамках ВТО. Проанализирован опыт Украины в ведении торгово-экономических споров в рамках ВТО, в частности определены их субъектно - объектную характеристику, систематизированы нарушеные статьи, их последствия. Сделаны выводы о необходимости улучшать дипломатические торгово - экономические отношения со странами; повышать уровень профессиональных знаний и компетенций представителей национальных внешне - экономических органов с целью защиты и улучшения национальных торговых интересов.

Yatsenko, D. Uskova. Ukraine's experience in international wto trade-economic disputes. The article examines the process of Ukraine's accession to the World Trade Organization, the country's desire to learn foreign markets, to participate directly in the formation of the newest rules of trade on the world market within the framework of the current round of multilateral trade negotiations in order to take into account the national interests of the country in trade and economic cooperation. The WTO Dispute Settlement Procedure is organized: first, within 60 days, consultations take place, then the Expert Groups are created, the report of the Expert Group is disseminated among the parties to the dispute and among the WTO members, the approval of the report by the Dispute Settlement Body, the report of the Appellate Body, Dispute resolution authority. The dispute resolution procedure is conducted for 1 year without appeal, or 1 year and 3 months if the appeal is not heard. It is analyzed that as of today trade disputes within the WTO are being solved and resolved more quickly than in the period from 1995 to 1999. The experience of Ukraine in conducting trade and economic disputes within the Organization is researched and analyzed. Ukraine has participated in trade conflicts within the WTO 13 times: 9 times as a claimant, 4 times as a defendant. The country has been involved more than 36 times as a third party. As a plaintiff, Ukraine filed an application for consultation against Armenia, Moldova, the Russian Federation, Australia, Kazakhstan, the Kyrgyz Republic. As defendant - with the Russian Federation, Moldova, Japan. It is concluded that it is necessary to improve the diplomatic qualities and professional knowledge of WTO legal relations to national representatives, to systematize the plan of our country's strategic membership in the WTO, to provide professional assistance to Ukrainian enterprises to properly plan their trade activities in accordance with the Organization's rules for improving efficiency and positive trade relations - members of the World Trade Organization.
